If you have both paths in the content pane with and without text ,is there a way to ONLY delete the ones that do NOT contain text
This applies to highlights drawn with a stylus that has been converted to base content, but not flattened it seems.

Path objects do not contain text, and there is no relation or way to check for a similar pattern so no, there is no way to discern this, force a split to occur, or delete only one "side" of the content.
The best way I can think of to somewhat emulate this assuming that you have text and a path object, both making the same shape in the same location, would be to use the "enhanced OCR" tool, and disable the options to "Ignore existing page text" while the output is set to editable text and images. This would allow the OCR to overwrite both instances of content with a new single layer of text only.
