Is there a possibility to get this "non-edit behaviour" without constatly having to press the shift-key? Would be great eg for presentations.

Hey pen,

I think that it's better the way it is now - the default action to be to select the current markup (the more frequently used action) and only the alternative (with Shift) to be to start a new one. Yes in your case you need the alternative functionality more but we are trying to make everyone happy :D

And for the pen tool especially if you are not exactly over another pencil line it will start drawing a new one and there is no problem for them to cross and overlap :)
